  • You agree to not access/use this site in any manner that can compromise the security of this site, including but not limited to, attempting to or gaining unauthorised access to the website, attempting to or delivering any unauthorised or malicious code to the website. Any damage, loss, civil damages suffered will be claimed by Eversci (Pty) Ltd against the user.

  • Any user who commits any of the offences detailed in Chapter 13 of the Electronic Communications and Transactions Act 25 of 2002 (the “ECTA”) shall, in addition to, criminal prosecution, be liable for all resulting liability, loss or damages suffered and/or incurred by Eversci (Pty) Ltd and its affiliates, agents and/or partners.

Intellectual property rights indicates any and all of the rights in and to intellectual property of any nature whatsoever, now or in the future, owned and/or controlled directly or under license by Eversci (Pty) Ltd, including but not limited to:

  • Eversci (Pty) Ltd’s rights, title and interest in and all content, technology, source code(s), trade secrets, logos, systems, methods, trademarks, trade names, styles, insignia, designs, patents and copyright, and all similar proprietary rights which may exist in any part of the world, registered or not.

  • All copyright and other intellectual property rights in all content, trademarks, software data, material, including logos, databases, text, graphics, icons, hyperlinks, confidential information, designs, agreements, and multimedia works, published on the website (“proprietary material”), are the property of Eversci (Pty) Ltd and are protected from infringement by local and international legislation 

  • Eversci (Pty) Ltd is the exclusive and sole licensee of all intellectual property rights contained on the website and the material published on it. These are protected by copyright and trademark laws. All rights are reserved.

  • You may print off one copy and you may download extracts of any page(s) from the website for your personal reference and you may draw the attention of others within your organization to the material available on the website.

  • Eversci (Pty) Ltd authorises you only to view, copy, temporarily download to a local drive and to print the content of this website, or any part thereof, provided that such content is used for personal purposes and for information purposes only in a non-commercial manner.

Risk, Limitation of Liability and Indemnity

The use of this website and its contents is entirely at the user's own risk and full responsibility and risk is assumed by the user. The user bears all risk of transmitting information in this manner. Under no circumstance will Eversci (Pty) Ltd be liable for any loss, harm or damage suffered by the user as a result thereof.

  • Eversci (Pty) Ltd, its affiliates, shareholders, agents, consultants or employees will be liable for any damages , including but not limited to any direct, indirect, special, incidental, consequential or punitive damages arising (whether in an action arising out of statute, delict or otherwise) related to the use of, or the inability to access or use the content of the mobile application or any functionality thereof, or the information contained on the website, or any linked website even if Eversci (Pty) Ltd knows or reasonably to have known or is expressly advised thereof.

  • The liability of Eversci (Pty) Ltd for damages suffered by the user, whether direct or indirect as a result of the malfunctioning of the website shall be limited to Eversci (Pty) Ltd rectifying the malfunction within a reasonable time and free of charge, provided that Eversci (Pty) Ltd is notified immediately of the damage or defective execution of the website

  • You agree to indemnify and hold Eversci (Pty) Ltd and all of its affiliates, successors, assigns and their respective officers, directors, employees, agents, representatives, licensors, advertisers and suppliers harmless from and against any and all losses, expenses, damages, costs and expenses (including legal fees), resulting from your use of the website and/or any violation of the terms of use of this agreement

Privacy& Cookie Policy

Eversci (Pty) Ltd takes protection of personal information seriously. We only use your information in accordance with our PAIA Manual, Privacy Statement and Terms & Conditions.

Eversci (Pty) Ltd only collects information in the following manners:

  • When you provide your information to us - through communications (via website, e-mail, and/or other social media platforms)  and/or creating a membership login and/or subscribing to newsletters, etc. 

  • If you participate in a promotion or competition and we request certain details such as name, e-mail, contact number, social media handles, etc.

Eversci (Pty) Ltd will make use of the information in but not limited to the following:

  • To add you as a member to our site

  • To validate/confirm your membership/client details

  • To communicate promotions or other offerings that may interest you (unless you have unsubscribed)

Eversci (Pty)  Ltd only retains your information in accordance to applicable laws and regulations, when that specific period ends we will dispose/delete/remove that information in the correct manner as stated in our PAIA Manual.

Breach or Cancellation

Eversci (Pty) Ltd is entitled, by notice to you and in addition to any other remedy available to it legally or under these terms of use, including obtaining an interdict, to cancel these terms of use and/or limit or deny such user the use of the website and services or to claim specific performance of any obligation whether or not the due date for performance has arrived, in either event without prejudice to Eversci (Pty) Ltd’s right to claim damages should any user:

  • Breach any of these terms of use; 

  • In the sole discretion of Eversci (Pty) Ltd, use the website in an unauthorised manner; or

  • Infringe any statute, regulation, ordinance or law.

Breach of these terms of use entitles Eversci (Pty) Ltd to take legal action and the user agrees to reimburse the costs associated with such legal action to Eversci (Pty) Ltd on an attorney and own client scale.
